Phase I, Phase II ESAs and EBSs
ATR Associates' staff has performed numerous Phase I and Phase II Environmental
Site Assessments (ESAs) conforming to the ASTM Standards, as well as ESAs that
go beyond the ASTM Standards. In addition, we have prepared NEPA and BRAC
documents for military clients, including FOSTs, FOSLs, and EBSs.
Phase I and Phase II ESAs
In addition to being sound business practice, the Phase I assessment was
developed to help landowners and potential landowners avoid liability under
CERCLA. The 1986 amendments to CERCLA, the Superfund Amendments and
Reauthorization Act (SARA) introduced the 'innocent landowner' defense.
The bona fide prospective purchaser can now avoid liability under CERCLA if
he/she, among other things, makes 'all appropriate inquiry' to determine the status of the property
before purchase. The USEPA has developed significant guidance regarding the
standard that must be met to secure the liability protection. We have performed:

If a Phase I ESA identifies one or more 'recognized environmental conditions'
further investigation is generally warranted. The Phase II ESA emphasizes
sampling and analysis of environmental media to determine the nature and extent
of any contamination. This information is used to determine if an
unacceptable risk is posed to humans or to the environment, and to evaluate
remedial measures if needed. ATR Associates staff have:
• Developed comprehensive Quality Assurance/Quality Control (QA/QC)
Plans • Performed Phase II ESAs according to ASTM's E1903-97(2002)

• Prepared risk assessments for Phase II properties, and
• Prepared recommendations for site remediation.

EBSs, FOSTs and FOSLs
An EBS is the DoDs counterpart to the private sector Phase I/Phase II.
Activities are similar. The EBS is based largely on existing documents and
records, but sampling and analyses of environmental media may be performed if
warranted. FOSTs and FOSLs (see below) are potentially available for
Property Area Types 1 - 4 under ASTM D 5746-95, Classification of
Environmental Condition of Property Area Types.
The primary purpose of a Finding of Suitability for Transfer (FOST) is
to document that the property is environmentally suitable for transfer by deed
under CERCLA and the DoD's FOST guidance. The FOST must document that
either the property is uncontaminated or that all needed remediation has been
completed, or is in place and operating properly and successfully (OPS).
The primary purpose of a Finding of Suitability for Lease (FOSL) is to
document that the property can be leased for an intended use without an
unacceptable risk to human health or the environment.
ATR Associates staff have prepared EBSs, FOSTs and FOSLs in support of DoD
BRAC activities. We have:
• Prepared EBSs
- Conducted records review and interviews
- Evaluated aerial photographs
- Performed visual inspections of subject and adjacent properties
- Prepared comprehensive EBS reports
conforming to DoD guidance
• Prepared FOSTs and FOSLs
- Analyzed the intended use of the property
- Prepared FOST and FOSL draft documents for properties where releases
have occurred, and for properties where releases have not occurred
- Prepared OPS documentation
